Terms of Service

By downloading, installing, or using the Gratis app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Gratis is a free peer-to-peer marketplace where users can list items they want to give away and connect with people who want to pick them up. All items on Gratis are free. No money changes hands through the App. Gratis charges no fees of any kind.

You must be at least 13 years old to use Gratis. By using the App you represent that you are at least 13 years of age. To post listings or contact other users you must verify your phone number and email address.

You are responsible for maintaining the security of your account. You agree to:

• Provide accurate and truthful information during signup
• Keep your contact information up to date
• Not share your account with others
• Notify us immediately of any unauthorized use of your account

When posting a listing on Gratis you agree that:

• The item is genuinely free — you will not request payment of any kind
• You own the item or have the right to give it away
• Photos and descriptions are accurate and not misleading
• The item is legal to give away in your jurisdiction
• You will follow through on confirmed pickup arrangements
• You will mark listings as unavailable once the item is gone

You may not list or exchange the following on Gratis:

• Illegal items or substances
• Weapons, firearms, or ammunition
• Stolen property
• Adult or explicit content
• Counterfeit or fraudulent items
• Live animals
• Hazardous materials
• Any item where a fee or exchange of value is requested

Gratis reserves the right to remove any listing that violates these rules without notice.

You agree not to:

• Harass, threaten, or abuse other users
• Create fake or misleading listings
• Use the App for any commercial purpose
• Attempt to collect payment for free items
• Spam other users with unsolicited messages
• Create multiple accounts to evade bans or restrictions
• Attempt to hack, scrape, or reverse engineer the App

All exchanges on Gratis happen in person. You are solely responsible for your safety during pickup arrangements. We strongly recommend:

• Meeting in public places when possible
• Bringing a friend to pickups
• Trusting your instincts — if something feels wrong, cancel
• Reviewing a user's profile and ratings before agreeing to meet

Gratis is not responsible for any incidents that occur during in-person exchanges.

Gratis is provided "as is" without warranties of any kind. We do not guarantee the accuracy of listings, the condition of items, or the behavior of other users. Use of the App is at your own risk.

To the fullest extent permitted by law, Gratis and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to damages arising from in-person exchanges, lost items, or user conduct.

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at support@thegratis.app.

We may update these Terms at any time. We will notify you of significant changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
